The Terms and Conditions detailed here govern the use of the Wildernessmag.co.nz website and ancillary services. You can access this Agreement at any time from menu at the bottom of every page on this website.

Please read this Agreement. Wilderness’s website provides an enjoyable and informative experience, but its users must abide by certain rules. Using the website will constitute your agreement to comply with these rules.

Use of Wilderness’s website by You

Your right to use the Wilderness Site (Wilderness, or Wilderness Site) is personal to you. You may not authorise others to use the service, and you are responsible for all of your own use of the service.

Other than connecting to Wilderness servers by HTTPS requests using a web browser, you may not attempt to gain access to Wilderness servers by any means – including, without limitation, by using administrator passwords or by masquerading as an administrator while using the Wilderness Site or otherwise.

You agree not to disrupt, modify or interfere with the service or its associated software, hardware and servers in any way and you agree not to impede or interfere with others’ use of the Wilderness Site. You further agree not to alter or tamper with any information or materials on, or associated with, the Wilderness Site.

You acknowledge that Wilderness has not reviewed and does not endorse the content of all sites linked to or from this site and is not responsible for the content or actions of any other sites linked to or from the Wilderness Site. Linking to any other service or site from the Wilderness Site is at your sole risk.

The Wilderness website is designed to be shared and used in a similar fashion to the print magazine. We cannot police usage and urge all subscribers to act honestly. We therefore ask that Wilderness subscribers do not share their website login details with another person, thereby allowing that person free access to the Wilderness website. Fair-use exceptions can be made to the partner or immediate family of a subscriber where, just as with the print magazine, such sharing would be expected to take place. An example of inappropriate sharing of login details is where a group or organisation such as a tramping club or business that has a paid subscription shares the website login details with multiple members or employees.

Intellectual Property Issues

The site is owned by Lifestyle Publishing Ltd. All of the content featured or displayed on the site, including, but not limited to still images, text, pictorial works, video, graphic designs, audio recordings, multimedia combinations, and computer programmes, including web-based programmes is owned or licensed by Lifestyle Publishing Ltd. It is not permitted for anyone to copy, download or use any content on this website without prior permission.

Wilderness allows our route notes and maps and GPX files to be downloaded for personal use only. These notes and files remain the property of Lifestyle Publishing Ltd and it is not permitted to use these files for any reason other than as personal navigation aids without prior permission.

Shopping

You agree to be financially responsible for all purchases made by you or someone acting on your behalf through this site. You agree to use the site, and to purchase services or products through the site, for legitimate, non-commercial purposes only. You also agree not to make any purchases for speculative, false or fraudulent purposes or for the purpose of anticipating demand for a particular product or service. You agree to only purchase goods or services for yourself or for another person for whom you are legally permitted to do so.

The site may provide, or third parties may provide, links to other sites or resources. Because Lifestyle Publishing Ltd has no control over such sites and resources, you acknowledge and agree that Lifestyle Publishing Ltd is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Lifestyle Publishing Ltd shall not be responsible or liable for any damage or loss caused or alleged to be caused in connection with use of or reliance on any such linked content, goods or services available on or through any such linked site or resource.

Privacy policy

Lifestyle Publishing is committed to protecting your privacy.

We will not collect any information about individuals, except where it is specifically and knowingly provided by them, such as when subscribing or making another purchase from Lifestyle Publishing. Examples of such information are:

The information collected will be used to send you the information you have requested and to help us develop the site to be useful to you. We may share non-personal aggregate statistics (group) data about our readers, sales and traffic patterns with partners or other parties. However, we do not sell or share any information about individual readers.

If you choose to subscribe to any Wilderness newsletter, we will from time to time email you with special offers or deals from our partners or sponsors. This service is completely discretionary, if you decide you no longer wish to receive the newsletter, just follow the unsubscribe instructions contained within the email.

Whilst we make every effort to provide you with links to high quality, reputable sites, they are not under our day-to-day control. When you click through to these sites you leave the area controlled by Wilderness. We cannot therefore accept responsibility for any issues arising in connection with either their use of your data, the site content or the services offered to our readers by these sites.

In addition to the company’s safeguards your personal data is protected in New Zealand by the Privacy Act. This provides amongst other things that the data we hold about you should be processed lawfully and fairly. It should be accurate, relevant and not excessive. The information should be kept up to date, where necessary, and not retained for longer than is necessary. You have the right to see what is held about you and correct any inaccuracies. Wilderness treats all the data held with the utmost care and security. Any details you give will remain completely confidential.

By subscribing to Wilderness, you will have your email automatically added to our email newsletters. The purpose of adding you to this mailing list is to share relevant content and help you make the most of your subscription. Our newsletters may include articles from the current issue, from our archive of articles, trip ideas and gear reviews. You can unsubscribe from this at any time by following the unsubscribe instructions contained within the email.

Subscriptions

  1. Issues of Wilderness are published in website format (“Website Format”) and the content of the Website Format publication is published in two other media, namely print format (“Print Format”) and digital magazine format (“Digital Format”).
  2. The content for the Website Format is used in the Print Format and Digital Format and all three formats contain the identical content and information.
  3. There are five Wilderness subscription options, namely:
    1. Print + Website + Digital” which includes Wilderness in Website Format, Print Format and Digital Format;
    2. Website + Digital” which includes Wilderness in Website Format, and Digital Format;
    3. Print + Website” which includes Wilderness in Website Format and Print Format; and
    4. Website” which includes Wilderness in Website Format.
      (collectively the “Subscriptions”)
  4. Depending on the Subscription option chosen, you may elect to subscribe and be billed annually, bi-annually, quarterly or monthly and you acknowledge that notwithstanding the billing frequency of the Subscriptions that Wilderness does not publish issues every month but is either published once a month or every second month in a double issue.
  5. When subscribing to Wilderness, you are subscribing to the content of the Website Format and acknowledge that the Print Format and Digital Format has the same content as the Website Format and that the difference in the Subscriptions is due to the associated costs to publish the Website Format content in the media for the Print Format and Digital Format but that the value of subscription is associated with access to the content contained in the Website Format.
  6. By subscribing to Wilderness, you acknowledge and accept that Lifestyle Publishing Ltd may at any time convert any of the Subscriptions to:
    1. only Digital Format and Website Format and no longer include Print Format media option; or
    2. only Website Format and no longer include Print Format and Digital Format media options.
  7. Lifestyle Publishing Ltd may only exercise the right to convert the Subscriptions by providing reasonable notice of not less than 3 months.
  8. The notice shall include the following information: –
    1. The details of the changes to the subscription, specifying the Format the subscription will be provided in;
    2. The extension of the subscription period determined in accordance with paragraph 9); and
    3. when the change will be implemented.
  9. Should the Subscriptions be converted pursuant to paragraph 6), any Subscriptions which included Print Format and/or Digital Format will continue, in the instance of paragraph 6)a), in Digital Format and Website Format or, in the instance of paragraph 6)b), in Website Format and the subscription (in the converted format) shall be extended in compensation of additional monies paid under the original subscription, in accordance with the following formula:
    1. Step 1: Apportionment of value of remaining subscription
      1. Take the costs of the subscription paid divided by the total number of months of the subscription paid (i.e. 12 months for an annual subscription / 6 months for bi-annual subscription / 3 months for quarterly subscription) and multiplied by the remaining months of the subscription.
    2. Step 2: Apportionment of value of converted subscription for the same remaining period
      1. in the instance of paragraph 6)a), take the costs of a Website + Digital subscription divided by the total number of months of the subscription paid and multiplied by the remaining months of the subscription paid; or
      2. in the instance of paragraph 6)b), take the costs of a Website subscription divided by the total number of months of the subscription paid and multiplied by the remaining months of the subscription paid.
    3. Step 3: Difference between subscription and converted subscription
      1. Take the difference between the amount determined in Step 1 on the one hand and the amount determined in Step 2 on the other.
    4. Step 4: Monthly dollar value of the subscription
      1. in the instance of paragraph 6)a), take the costs of a Website + Digital subscription divided by the total number of months of the subscription paid; or
      2. in the instance of paragraph 6)b), take the costs of a Website subscription divided by the total number of months of the subscription paid.
    5. Step 5: Additional months
      1. Take amount determined in Step 3 and divide by the sum determined in Step 4 and round up to the higher whole number.
    6. Step 6: New subscription period
      1. Take the remaining subscription period plus the number determined in Step 5.

For example: If at the time of conversion, the Print + Website + Digital subscription cost was $100 and ten months of the annual subscription remained and the Website subscription costs was $70, the additional months would be calculated as follows: –

Step 1 $100 (Print + Website + Digital costs)/ 12 x 10 =$83.33

Step 2: $70 (Website costs) / 12 x 10 = $58.33

Step 3: $83.33 – $58.33 = $25.00

Step 4: $70 / 12 = $5.83 per month

Step 5: 25 / 5.83 = 4.28 rounded up to 5

Step 6: 10 + 5 = 15

Resulting in the subscription period being continuing for 15 months, consisting of the original remaining 10 months plus 5 additional months in accordance with the formula.

Force Majeure 

Lifestyle Publishing Ltd shall not be in breach of these Terms and Conditions should Lifestyle Publishing Ltd fail to perform any of its obligations when such failure shall have been occasioned by or in connection with or in consequence of Force Majeure.

“Force Majeure” means any act of God, strike, lockout, work stoppage or other labour hindrance, confiscation or expropriation, embargo, blockade, insurrections, public mains electrical supply failure, fire, floods, storm explosion, nuclear accident, sabotage, revolution, riot, act of war whether declared or not, warlike operations, requirement or restriction of governmental authorities, order of the Court, earthquake, slide, epidemic, quarantine restriction, software failure or any other similar cause beyond the reasonable control of Lifestyle Publishing Ltd, which prevents, hinders or interferes with the performance by Lifestyle Publishing Ltd of its obligations.

Subscription cancellation

Subscriptions can be cancelled at any time by writing to Wilderness, Box 260041, Howick East, Auckland 2146 or by email to subscribe@lifestylepublishing.co.nz or by phone: 09 5702 658. If you have bought your subscription at this website, you may also unsubscribe in the ‘My account‘ area of the website. The cancellation of your subscription will take effect before the next payment is due.
